The FloMap Terms of Use, Health & Safety Disclaimer Breathwork Program Please read this document carefully before using any FloMap program, session, or content. 1. Nature of This Service The FloMap provides self-guided breathwork audio sessions, educational content, and community support designed to support general emotional wellbeing, stress regulation, and personal development. FloMap is a wellness program. It is not a clinical, medical, or mental health treatment service. The content offered by FloMap — including all breathwork sessions, written materials, voice guidance, and any supplementary resources — is intended for general wellness and educational purposes only. It does not constitute, and must not be used as a substitute for, any of the following: • Psychological assessment, diagnosis, or treatment • Psychiatric evaluation or management • Psychotherapy, counselling, or clinical social work • Medical advice, diagnosis, or treatment of any kind • Crisis intervention or emergency mental health support • Any regulated health profession service as defined by applicable law in your jurisdiction The breathwork facilitators, content creators, and team members associated with FloMap are not acting in a clinical capacity when delivering program content. Any guidance offered within sessions — however it may feel personally meaningful — does not create a therapeutic, medical, or professional relationship between FloMap and any participant. 2. When Professional Support Is Required FloMap is designed to complement, not replace, accredited professional care. We strongly encourage you to seek qualified professional support if any of the following apply to you: Mental Health Conditions • You are currently experiencing, or have a history of, a diagnosed psychiatric condition including but not limited to: major depressive disorder, bipolar disorder, schizophrenia, schizoaffective disorder, borderline personality disorder, dissociative disorders, post-traumatic stress disorder (PTSD), complex PTSD, obsessive-compulsive disorder, or any anxiety disorder requiring clinical management. • You are currently experiencing psychotic symptoms, including hallucinations, delusions, or loss of contact with reality. • You are currently experiencing suicidal ideation, self-harm urges, or thoughts of harming others. • You are in an active mental health crisis or have been recently discharged from inpatient psychiatric care. Substance Use • You are in active addiction or early recovery from substance use disorder, particularly in the first 90 days of sobriety or abstinence. • You are using substances that may interact with altered states or heightened emotional processing. Physical & Medical Conditions • You are pregnant or may be pregnant. Kapalabhati pranayama (activated breathing) is contraindicated during pregnancy and must not be used. • You have been diagnosed with, or are being treated for, any cardiovascular condition including but not limited to: hypertension, arrhythmia, heart disease, recent cardiac events, or implanted cardiac devices. • You have a history of seizures or epilepsy. • You have any respiratory condition including asthma, COPD, or a history of spontaneous pneumothorax. • You have recently undergone surgery or are managing a serious physical injury. • You have been advised by a medical professional to avoid breath-holding, hyperventilation, or intensive breathing exercises. If you are uncertain whether any session content is appropriate for your specific health circumstances, please consult a qualified healthcare professional before participating. 3. Crisis Support Resources FloMap is not a crisis service and cannot provide emergency support. Assumption of Risk By accessing and using any FloMap session, content, or program material, you acknowledge and agree that: • Breathwork practices, including extended exhale, coherence breathing, and kapalabhati pranayama, involve deliberate manipulation of the breath and may produce physical and emotional responses including but not limited to: tingling sensations, lightheadedness, emotional release, temporary increases in heart rate, altered states of consciousness, and the surfacing of strong emotions or memories. • You are voluntarily participating in these practices and assume full responsibility for any physical, psychological, or emotional effects that may result. • You have read and understood the contraindications listed in Section 2 of this document and confirm that none of the listed conditions apply to you, or that you have received clearance from a qualified healthcare professional. • FloMap, its founders, facilitators, content creators, employees, contractors, and affiliated parties are not responsible for any harm, injury, adverse reaction, or negative outcome arising from your participation in the program. • You will stop any session immediately if you experience dizziness, chest pain, shortness of breath beyond normal breathwork sensation, panic, significant distress, or any other symptom of concern, and will seek medical attention if required. 5. No Therapeutic Relationship Participation in FloMap does not create a therapeutic, clinical, medical, or fiduciary relationship of any kind between you and FloMap, its founders, facilitators, or team members. The content of FloMap sessions draws from publicly available frameworks including somatic psychology, mindfulness-based cognitive therapy, Ayurvedic principles, Taoist philosophy, and Buddhist psychology. References to these frameworks are educational and informational in nature. They do not constitute the practice of psychotherapy, medicine, or any regulated health profession. The program vocabulary used throughout FloMap — including terms such as “guardians,” “the hidden ones,” “softening the grip,” and “the laying down” — is original to FloMap and is used in a general wellness and self-development context. It is not clinical terminology and does not imply the delivery of any licensed clinical modality. 6. Limitation of Liability To the fullest extent permitted by applicable law in your jurisdiction, FloMap and its associated parties expressly disclaim all liability for: • Any physical injury, illness, or adverse medical event arising from participation in breathwork sessions or program content. • Any psychological distress, emotional destabilization, or mental health deterioration arising from program participation. • Any decision, action, or inaction taken by a participant as a result of program content. • Any harm arising from the delay or avoidance of professional medical or psychological care. • Any harm arising from reliance on program content as a substitute for clinical treatment. Where applicable consumer protection or personal injury laws in your jurisdiction do not permit the full exclusion of liability, FloMap’s liability is limited to the maximum extent permitted by law. Jurisdictional Notes FloMap is accessed by members globally. The following notes are provided for awareness, and do not constitute legal advice. Members are encouraged to seek independent legal advice if uncertain of their rights or obligations under local law: • Canada: Consumer protection legislation varies by province. Nothing in this disclaimer limits rights afforded to consumers under applicable provincial legislation. • United Kingdom & European Union: Nothing in this disclaimer excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded under the Consumer Rights Act 2015 (UK), the EU Consumer Rights Directive, or applicable national implementing legislation. • Australia: Nothing in this disclaimer excludes statutory guarantees provided under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010). 7. Privacy & Confidentiality FloMap takes the privacy of its members seriously. The following applies to all program interactions: • FloMap is not a confidential clinical communication channel. Any information you share in community settings, feedback forms, or communications with FloMap staff does not carry the legally protected confidentiality of a therapeutic relationship. • We handle personal information in accordance with applicable privacy legislation, including but not limited to: the Personal Information Protection and Electronic Documents Act (PIPEDA) in Canada, the General Data Protection Regulation (GDPR) in the European Union and United Kingdom, the Privacy Act 1988 in Australia, and applicable state privacy laws in the United States. • Our full Privacy Policy, which governs the collection, use, and storage of personal data, is available at [FloMap Privacy Policy URL] and forms part of your agreement with us. 8. Children & Minors FloMap content is intended for adults aged 18 years and older, or the age of majority in your jurisdiction, whichever is greater. The program content addresses complex emotional and psychological material that is not appropriate for minors. FloMap does not knowingly collect personal information from minors and does not permit minors to participate in the program without the express written consent of a parent or legal guardian. Intellectual Property All content within the FloMap Summit Series — including session scripts, audio recordings, program frameworks, original vocabulary, structural formats, and all associated written and audiovisual materials — is the intellectual property of FloMap and its creators, protected under applicable copyright, trademark, and intellectual property law. Program content may not be reproduced, redistributed, adapted, transmitted, performed publicly, or used for commercial purposes without prior written permission from FloMap. Personal, non-commercial use by enrolled members is permitted within the terms of your membership. The program vocabulary developed for FloMap — including but not limited to the terms listed in the Program Vocabulary section of the session documents — is original to FloMap. Use of this vocabulary in competing products, services, or derivative works without authorization is prohibited. 10. Governing Law & Dispute Resolution This disclaimer and any dispute arising from your use of FloMap will be governed by the laws of [Jurisdiction — e.g., Province of Ontario, Canada], without regard to conflict of law principles.
